Emily Dodds Powell’s practice focuses on complex civil litigation, white collar criminal defense, and investigations.  Emily has handled complex civil matters in state and federal court for both plaintiffs and defendants, including employment disputes and cases involving allegations of fraud, Consumer Protection Act violations, breach of contract, and business torts. 

Emily also represents businesses, company employees, and witnesses in False Claims Act investigations and white collar criminal cases, including environmental, health care, and government contracting matters.

In addition to her litigation practice, Emily conducts internal investigations for private companies and government agencies.

Emily’s recent clients and matters have included representation of:

  • Health care provider in action brought by Washington Attorney General alleging manslaughter related to patient’s fall at nursing home.  Obtained dismissal before trial.
  • Municipality in case alleging qui tam retaliation, First Amendment retaliation, takings, and tortious interference.  Obtained summary judgment dismissal.
  • Owner of local company in criminal action alleging Clean Water Act violations.
  • Health care providers in class action alleging breach of contract relating to billing for emergency room services.
  • Digital entertainment company in putative class action relating to online gaming.
  • Employees in noncompete disputes and other employment disputes and negotiations.
  • Large public employer in discrimination lawsuit.
  • Nonprofit in employment counseling and disputes.
  • Technology company in patent disputes.
  • Online travel website in consumer class action alleging RICO and consumer protection violations arising out of charges for “taxes and fees” on travel bookings.  Obtained dismissal and successfully moved to compel arbitration in related action.
  • Nonprofit in arbitration involving claims for breach of contract brought by multiple plaintiffs. Obtained a favorable arbitration award resulting in a significant financial award for the client.
  • Online travel website in breach of contract action brought by national commercial real estate firm seeking compensation for work performed in acquisition of company’s Seattle campus.  Obtained dismissal on the pleadings.
  • Publicly-elected Washington State Auditor in trial and appeal involving charges of wire fraud, money laundering, perjury, tax fraud, and false statements.
  • Government defense contractor and employees in separate False Claims Act investigations.
  • Numerous health care facilities and providers in False Claims Act investigations regarding alleged excessive Medicare billing, Stark Act violations, and Anti-Kickback Act violations.

Prior to joining the firm, Emily practiced in the litigation department of Paul Hastings LLP in San Francisco, California.  Before entering private practice, she served as a law clerk to United States District Judge William B. Shubb in the Eastern District of California.  Emily had previously interned with the U.S. Attorney’s Office in Sacramento, California.

Emily graduated from Harvard Law School, where she served as Notes Editor and Outreach Chair for the Harvard Law Review.  She received her bachelor’s degree from the University of California, Berkeley in Economics and Philosophy.
